Terms of Use
These terms govern the relationship between you and the provider of the "GeoWunder" app for the use of the app and the website geowunder.com.
1. Scope and provider
These terms ("Terms") govern the use of the mobile app "GeoWunder" in the Apple App Store and Google Play Store as well as the website geowunder.com. Provider is Skills4Life GbR, Salierring 44, 50677 Köln, Germany; further contact details in the imprint.
By installing the app and starting it for the first time you confirm that you have read and accepted these Terms.
2. Beta phase
In-app purchases are inactive during the beta phase. All functions are provided free of charge.
3. Eligibility
- You must be at least 13 years old. If you are a minor (under 18), you need parental consent.
- You need a compatible mobile device with GPS, a reasonably current version of iOS or Android, and an internet connection.
- You either create an anonymous account or sign in via Apple, Google, or an email link. You commit to providing truthful information and not to share your account.
4. Scope of features
GeoWunder lets you build location-based rallyes ("challenges"), have AI-generated tours made for you, and play rallyes solo or with others ("party mode"). Details about the data we process are in the privacy policy.
5. Permitted use
You may use the app for private, educational, and non-profit educational purposes. Any commercial use beyond that — particularly the resale of rallye content — requires our prior written consent.
6. Prohibited use
You agree not to use GeoWunder in any way that violates applicable laws or third-party rights. In particular, the following is forbidden:
- Posting insulting, threatening, discriminatory, sexualised, age-inappropriate or otherwise illegal content in rallye descriptions, photo/video uploads, or chat messages.
- Entering, uploading or sharing personal data of third parties without their consent — in particular no recognisable photos of people without consent.
- Placing waypoints on dangerous terrain (railways, construction sites, steep slopes) or impermissible locations (private property, military zones).
- Nature protection and environment: Waypoints in protected areas — nature reserves, national parks, bird-protection zones, habitats of endangered species — are only allowed where local regulations permit access. Stay on designated paths, do not leave marked trails, leave no trace, and respect breeding seasons.
- Sharing the location of other players outside the app or stalking them.
- Using the app through automated means (bots, scripts, modified clients) or circumventing game mechanics (e.g. GPS spoofing for in-app advantages).
- Circumventing security mechanisms, reverse-engineering, or abusively calling our server endpoints.
- Creating multiple accounts to circumvent bans.
7. Your content and licence
You retain all rights to the content you put into GeoWunder (text, photos, videos, your own rallyes). You grant us a non-exclusive, worldwide, royalty-free licence — limited to the duration of your use — to store such content, display it to fellow players, and process it for the technical delivery of the app, including transmission to our processors (see privacy policy).
By uploading you confirm that you hold the necessary rights and that no third-party rights are violated.
8. AI-generated content
Waypoints, routes, tasks, station descriptions, quiz questions, answers, and place information in GeoWunder may be created by generative AI (in particular Google Gemini). Such content is not editorially reviewed. We make no warranty as to its accuracy, completeness, timeliness, cultural appropriateness, or fitness for a particular purpose.
8.1 Factual accuracy
AI models can produce so-called hallucinations — statements that sound plausible but are factually wrong. Quiz answers, historical claims, statements about persons, and place descriptions must be independently verified before use, particularly in an educational context. Do not rely on AI suggestions for safety-, health- or legally-relevant decisions.
8.2 Safety risks of AI-generated waypoints
We accept no liability for damage caused by playing AI-generated waypoints without prior review — see also §14.
8.3 Personality rights and inappropriate content
The AI may produce content that touches on third-party personality rights (e.g. mentioning living persons by name) or that is inappropriate at certain locations — for example memorials, religious or sacred sites. You must review such content before publishing or sharing it with other players and adjust as needed. Use the in-app report function for content that is unlawful or ethically questionable, or edit the rallye before playing or sharing it.
When you share an AI-generated rallye with third parties (e.g. in party mode or via link), you take editorial responsibility for the content you thereby distribute (see §7 and §16).
8.4 Rights in AI output
To the extent the AI services used (Google Gemini) grant users rights in the output, the corresponding rights in your specific output pass to you. We make no representation of exclusivity: similar or identical AI results may be produced for other users. Copyright protection in purely AI-generated output is currently contested under German and European case law and is not guaranteed.
8.5 Your inputs are not used for AI training
Your inputs (tour themes, target audiences, location queries, uploaded photos for task verification) are passed to the AI provider only for the immediate processing of your request. Under the contractual terms with the AI provider (Google Gemini via Vertex AI in EU region europe-west4), your data is not used to train or improve the AI models, and no third-country transfer of this content takes place. Details in Privacy Policy §6 and §7.
9. Multiplayer conduct and reporting mechanism (DSA)
Treat fellow players respectfully. Within the app you will find a "Report" function on questionable content or behaviour. We process reports without undue delay — typically within business days — and reserve the right to remove reported content or restrict accounts. This reporting mechanism implements our obligations under Art. 16 of the Digital Services Act (Regulation (EU) 2022/2065, "DSA").
Statement of reasons (Art. 17 DSA): if we take an action against you (remove content, restrict or suspend your account), you will receive a clear statement of reasons indicating the basis under these Terms or applicable law, plus information on your right to appeal under Section 10.
In cases of serious or repeated violations we may suspend accounts without prior warning; in all other cases we will warn first.
10. Internal complaint handling (Art. 20 DSA)
If you disagree with a measure we have taken (e.g. removal of your rallye, account suspension), you may submit a complaint within six months:
- by email to info@skills4life.de with subject "DSA complaint" and details of the underlying measure, or
- via the feedback form with category "Other".
We review every complaint fairly, diligently, without undue delay, and without using automated means. You will receive a reasoned decision. If your complaint succeeds, we will reverse the measure without delay.
You also retain the right to out-of-court dispute resolution under Art. 21 DSA via a certified body of your choice or to take court action.
10.1 Requests from property owners and location operators
Even when a waypoint is not unlawful, it may affect the legitimate interests of third parties — property owners, operators of sensitive sites (memorials, cemeteries, schools), or authorities. You can submit such concerns informally to info@skills4life.de with the subject "Location request" — including:
- the affected location (address or coordinates);
- a brief reason (e.g. "my property", "site of remembrance");
- where helpful, a proof of identity (ownership, role).
We review each justified request promptly and remove the relevant waypoints from further tour generation to the extent technically feasible. This pathway is separate from the DSA procedure; it addresses conflict prevention, not unlawful content.
11. Location data
The app requires access to your location for its core functions. During a game session, location may also be captured in the background (lock-screen display, detection of reached waypoints). In party mode your progress — including your position — is shared with other participants of the session.
You alone are responsible for your safety while playing (see Section 14).
12. In-app purchases ("AI coins")
Once the beta phase ends, you will be able to purchase digital content ("AI coins") in the app. AI coins unlock AI-generated tasks in your own rallyes. Payment is processed exclusively by Apple or Google in accordance with their respective terms; we do not receive any payment data.
12.1 Pricing and consumption
Currently available coin packs and prices are shown in the in-app purchase dialog. Coins are non-transferable to other accounts and expire with the deletion of your account — no refund is owed for purchased but unconsumed coins in that case.
12.2 Withdrawal right (EU / EEA)
Under EU consumer law a 14-day withdrawal right generally applies to contracts for the supply of digital content. With your express consent and acknowledgement that your right of withdrawal will expire upon performance, we begin executing the contract before the withdrawal period expires. By expressly consuming a purchased AI coin (i.e. using it to generate content), you waive your right of withdrawal for that coin (§ 356(5) German Civil Code, transposing Art. 16(m) Directive 2011/83/EU). We remind you of this before the first use.
Coins that you have purchased but not yet consumed can be refunded through the relevant app store (Apple or Google) within the withdrawal period — we do not handle payment ourselves. Contact us directly only if the store refuses a refund without giving reasons.
12.3 United States — all sales final after consumption
For users in the United States: all in-app purchases are non-refundable once the corresponding coin has been used, except where required by applicable consumer-protection law. Refund requests for unused coins should be made through the App Store or Google Play refund channels:

Nothing in this Section limits any non-waivable statutory rights you may have under applicable law in your state or country.
12.4 Warranty and defects
If purchased coins are not credited or the unlocked feature is not delivered, contact us at info@skills4life.de within 30 days. We will either credit the coins or assist with the store-side refund.
12.5 Minors
Purchases by minors are only allowed with parental consent. We recommend configuring the family / screen-time settings of your device so that in-app purchases require approval.
13. Availability, maintenance, changes
We strive for high availability but do not guarantee uninterrupted use. Maintenance windows and short outages may occur. We reserve the right to develop, restrict or discontinue features to a reasonable extent.
14. Disclaimer for outdoor use
14.1 Traffic and wayfinding
GeoWunder is not a substitute for road navigation or a hiking map. GPS data may be inaccurate. We accept no liability for wayfinding, personal injury, property damage, or conflicts with third parties resulting from playing in the real world.
Special note for AI-generated routes: for automatically generated tours, inspect the stations on the map before you start — the AI has no real-time information about construction works, closures, or property rights. See §8.2 for details.
14.2 Physical fitness and breaks
A tour can be physically demanding depending on its length and terrain. Only play if you are physically able to. Take breaks when feeling exhausted, overheated, cold, or in pain, and cancel the tour if needed. Wear suitable clothing and sturdy footwear, carry enough water, and check the weather forecast. GeoWunder is not a sports or training program and does not replace medical advice.
14.3 Attention and screen use
Looking at your phone screen while moving can cause stumbling, falls, or collisions. Stop walking before you look at the screen, do not hold the device while crossing streets, cycling, or driving. If you experience eye strain, dizziness, or nausea from prolonged scrolling, take a break.
14.4 Playing with minors
When parents, guardians, or teachers run tours with children or adolescents, they are responsible for selecting age-appropriate stations, supervising the activity, and assessing the safety of the waypoints (see also §3 and §8.2). We recommend not sending younger players to unfamiliar locations without supervision.
15. Liability
We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body, or health. For ordinary negligence we are liable only in case of breach of material contractual obligations (cardinal obligations) and only up to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.
During the beta phase, any further liability — in particular for data loss caused by backend errors or restricted features — is excluded to the extent permitted by law.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Skills4Life GbR, its legal representatives, employees, and processors from and against any claims, liabilities, damages, losses and reasonable legal expenses brought against us by a third party as a result of:
- content you post that infringes third-party rights (copyright, personality rights, trademark, etc.);
- your violation of the prohibition on uploading personal data of third parties;
- your tampering with the app or our servers (e.g. GPS spoofing, reverse engineering, multi-account creation to circumvent bans);
- your culpable misconduct in multiplayer (harassment, discrimination).
We will give you reasonable notice of any such claim and reasonable cooperation in your defence (at your expense). The indemnification does not apply to the extent the claim is caused by our own fault.
17. Termination and account deletion
You may end the relationship at any time by uninstalling the app and/or deleting your account under Settings → Delete account. Account deletion permanently removes all data associated with your identifier (see Privacy Policy §17).
We may suspend accounts temporarily or close them permanently for serious or repeated violations.
18. Changes to these Terms
We may amend these Terms if required for legal or functional reasons. Material changes will be announced at least four weeks in advance inside the app and, where available, by email. You may object within that period; in that case the relationship ends upon entry into force of the changes. If you do not object or continue using the app after entry into force, the changes are deemed accepted.
19. Force majeure
To the extent we are prevented from providing the app by events outside our reasonable control — in particular large-scale internet or power outages, natural disasters, war, government orders, strikes, or failures of essential third-party services (e.g. Apple, Google, Firebase) — we are released from our performance obligations for the duration and scope of such events. We endeavour to inform you of such events.
20. Relationship to app stores and third-party services
20.1 Apple App Store
If you obtain GeoWunder via the Apple App Store, Apple's Licensed Application End User License Agreement applies in addition. You acknowledge that:
- these Terms are concluded solely between you and us, not with Apple;
- Apple has no obligation to furnish support or maintenance for the app;
- Apple is not liable in case of a conflict between these Terms and Apple's terms;
- Apple is a third-party beneficiary of these Terms and may enforce them against you as an end user if you obtained the app from the App Store.
20.2 Google Play Store
If you obtain the app via the Google Play Store, the Google Play Terms of Service apply additionally, including refund and family policies where relevant.
20.3 Google Maps Platform
Maps, routes, place information and photo previews in the app are provided by the Google Maps Platform. By using these features you also accept the Google Maps / Google Earth Additional Terms of Service and the Google Privacy Policy. We do not persistently store Maps Content — it is fetched fresh from Google APIs on every function call (see Privacy Policy §8). AI-derived description texts and mission hints built on top of this data are not Maps Content and may be retained long-term.
20.4 Backend platform (Firebase / Google Cloud)
The app uses services from the Firebase Platform (authentication, database, Cloud Functions, Hosting, App Check) and Google Gemini via Vertex AI (EU region europe-west4) for image and tour generation. These services are provided to us as processors; details on data flows and any third-country transfers are in our Privacy Policy §3, §6, §11 and §16.
21. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of the state in which you have your habitual residence remain unaffected.
For disputes with businesses, the place of jurisdiction is the provider's place of business. For disputes with consumers, statutory rules apply.
22. Dispute resolution
The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
23. DMCA notice and takedown (USA)
We respond to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content in GeoWunder infringes your copyright, please send a written notice to our designated agent containing:
- your physical or electronic signature;
- identification of the copyrighted work claimed to be infringed;
- identification of the allegedly infringing content (in our app: rallye name and station, or the precise message) and information sufficient to allow us to locate it;
- your name, address, telephone number, and email;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We may also accept counter-notifications from users whose content was removed in response to a DMCA notice. Repeat infringers' accounts will be terminated in accordance with §512(i) DMCA.
24. Survival
The following Sections survive termination of these Terms, deletion of your account, or suspension of your account to the extent necessary to give them effect: §7 (your content licence, limited to the duration that content is stored), §8 (AI-content disclaimer), §15 (Liability), §16 (Indemnification), §21 (Governing law), §22 (Dispute resolution), §23 (DMCA), and §25 (Severability).
25. Severability
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by the relevant statutory regulation.
